1. Introduction & Acceptance

These Terms of Service ("Terms") govern your access to and use of the FreeCryptoTools platform, including the open-source self-hosted software available at our GitLab repository, our cloud-hosted services, our website at freecryptotools.org, and any associated APIs, plugins, themes, or marketplace listings (collectively, the "Platform"), operated by NK Digital ("FCT," "we," "us," or "our").

By downloading, installing, self-hosting, accessing, or using the Platform in any capacity, you ("User," "you," or "Developer") agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Dual-Licensing Structure

FCT operates under a dual-licensing model:

  • Core Software License: The core FCT dApp builder software is open-source, licensed under the MIT License. You are free to view, fork, modify, and self-host the source code in accordance with that license.
  • Commercial/Cloud License: Use of FCT's cloud-hosted infrastructure, managed services, or any production deployment tied to a custom domain operates under this separate commercial Terms of Service, independent of the open-source license governing the code itself.

Nothing in the open-source license grants you rights to FCT's trademarks, hosted infrastructure, or commercial services beyond what is explicitly stated here.

3. Production License Keys

  • Self-hosting is free. You may install, run, and experiment with FCT on your own infrastructure at no cost, and license keys for this purpose are unlimited.
  • Production use requires a valid license key. Running FCT in a production environment, or connecting any custom domain to an FCT-built dApp, strictly requires generating and maintaining a valid license key issued through our central platform.
  • Key Revocation. FCT reserves the absolute right to revoke or deactivate any license key, at our sole discretion and without prior notice, if we determine that a domain associated with that key is hosting malicious dApps, phishing infrastructure, rug-pull schemes, unregistered securities offerings, or any activity that violates applicable law or these Terms.
  • Revocation of a license key may render the associated production deployment non-functional. FCT is not liable for any resulting loss of access, revenue, or data.

4. AI-Generated Code & Smart Contract Disclaimer

FCT includes an AI layer, including smart contract generation, an AI orchestrator with an exploit-checklist review process, and Foundry-based testing integration (collectively, the "AI Layer").

  • Provided "As-Is." The AI Layer, and any code, smart contracts, or configuration it produces, is provided purely as an automated development aid. It is not a substitute for professional legal, financial, or security review.
  • Mandatory Human Review. You, the User, assume 100% legal and financial responsibility for reviewing, testing, and independently verifying any AI-generated code before deploying it — to testnet, mainnet, or any live environment.
  • No Warranty on AI Logic. FCT makes no representation or warranty that AI-generated smart contracts are free of bugs, logic errors, structural vulnerabilities, or economic attack vectors, including but not limited to reentrancy attacks, oracle manipulation, flash-loan exploits, front-running, or integer overflow/underflow. The exploit-checklist and orchestrator layer are best-effort quality tools, not a guarantee of security.
  • Passing FCT's internal test/compile loop does not constitute a security audit or certification of any kind.

Mandatory Third-Party Audit. FCT strongly mandates that you obtain an independent, third-party smart contract audit before deploying any AI-generated code to a production mainnet. Failure to do so is entirely at your own risk. FCT bears no responsibility for losses resulting from unaudited deployments.

5. Third-Party Marketplace (Themes, Plugins & Extensions)

FCT may operate or host a marketplace through which independent third-party developers list themes, plugins, or extensions ("Marketplace Items") for use with the Platform.

  • No Endorsement. FCT acts solely as a neutral venue connecting developers with Marketplace Items. Listing on the Marketplace does not constitute FCT's endorsement, certification, or guarantee of any Marketplace Item's security, functionality, or stability.
  • Use at Your Own Risk. You acknowledge that Marketplace Items are built by independent third parties and may contain bugs, vulnerabilities, or malicious code. You assume all risk associated with installing or using any Marketplace Item.
  • Developer Indemnification. Any third-party developer listing an item on the FCT Marketplace agrees to defend, indemnify, and hold harmless FCT against any claims, damages, or lawsuits brought by users arising from that developer's Marketplace Item. (See the separate Developer Terms of Service / Marketplace Agreement for full terms.)
  • FCT reserves the right to remove any Marketplace Item at any time, for any reason, including failed security review or reported malicious behavior.

6. No Custody of Assets

FCT's Platform never touches, holds, custodies, or otherwise manages user crypto assets, smart contract funds, treasury balances, or liquidity of any kind. All transactions executed through dApps built on FCT (including swap, commerce, and payment plugins) occur directly on-chain, between the user's own connected wallet and the relevant smart contracts or protocols (e.g., Uniswap v3). FCT is a software tooling provider, not a custodian, broker, exchange, or money transmitter.

7. Limitation of Liability

To the maximum extent permitted by law:

  • FCT's total aggregate liability arising out of or relating to these Terms or your use of the Platform shall not exceed the total fees you paid to FCT for cloud-hosting or commercial services in the 12 months preceding the claim, or ₹0 (zero) for free, self-hosted users who have paid FCT nothing.
  • FCT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of funds, loss of profits, loss of data, or reputational harm, even if advised of the possibility of such damages.
  • This limitation applies regardless of the legal theory asserted (contract, tort, negligence, or otherwise).

8. Dispute Resolution & Class-Action Waiver

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of India. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

9. Acceptable Use

You agree not to use the Platform to:

  • Build, deploy, or promote fraudulent schemes, including rug-pulls, Ponzi/pyramid structures, or phishing sites;
  • Violate applicable securities, anti-money-laundering (AML), or sanctions laws, including deploying unregistered securities disguised as tokens;
  • Infringe on the intellectual property or rights of others;
  • Attempt to circumvent license-key enforcement or reverse-engineer commercial licensing mechanisms;
  • Introduce malware, exploits, or malicious code into the Platform, Marketplace, or any dApp built with FCT.

Violation of this section may result in immediate license revocation and termination of access, in addition to any other remedies available to FCT.

10. Regulatory Disclaimer (Tokenization & RWA Use Cases)

If you use FCT to build applications involving real-world asset (RWA) tokenization, securities-like tokens, or other regulated financial instruments, you are solely responsible for determining and complying with all applicable securities, commodities, and financial-services regulations in every jurisdiction where your application operates or is accessible. FCT provides software tooling only and does not provide legal, regulatory, or investment advice, and does not review deployments for regulatory compliance.

11. Termination

FCT may suspend or terminate your access to cloud services or revoke your license key at any time for breach of these Terms. Open-source self-hosted use remains governed independently by the applicable open-source license and is not subject to FCT-initiated termination, though such use is not eligible for production/custom-domain functionality without a valid key.

12. Changes to These Terms

FCT may update these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles.
